You may not copy, modify, distribute, or create derivative works from any content without our express written consent.

4. User Submissions and License

By submitting any content, feedback, quiz responses, suggestions, or other data to us (“User Content”), you grant Setly Labs a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and display such User Content to operate and improve the Services, including to develop new features and train AI models.

You represent and warrant that you have all necessary rights to submit the User Content and that it does not violate any third-party rights.

5. AI and Machine Learning

You acknowledge and agree that Setly Labs may use data collected through the Services, including User Content, in accordance with our Privacy Policy, to train and improve artificial intelligence and machine learning models that support and enhance our Services and future innovations.

6. Third-Party Services and Links

The Services may include links to third-party websites or tools. Setly Labs does not control and is not responsible for third-party content or practices. Your interactions with third-party services are solely between you and those third parties and governed by their terms.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. SETLY LABS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SETLY LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID TO USE THE SERVICES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Setly Labs and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• •Your violation of these Terms
• •Your violation of any rights of another

10. Modifications to the Terms

We may update these Terms from time to time. If material changes are made, we will post the updated Terms on this page and, if required by law, notify you by email. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Monmouth County, New Jersey for any dispute arising out of or relating to these Terms or the Services.

12. Miscellaneous

• •Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Setly Labs regarding your use of the Services.
• •Severability: If any provision is held invalid, the remaining provisions remain in effect.

• •Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may freely assign these Terms.
